- THE SOCIETY: Means Managing Committee of Gurdwara Sri Guru Teg Bahadur Sahib, Fatehgarh (Madran) Sec-34-D (Defence Colony), Chandigarh.
- YEAR: Means the period commencing from 1st April and ending with 31st March.
- REGISTERED ADDRESS: The registered address of the society shall be Gurdwara Sri Guru Teg Bahadur Sahib Fatehgarh (Madran) Sec-34-D (Defence Colony), Chandigarh U.T.
- AREA OF OPERATION: INDIA (with retrospective effect).
- AIMS AND OBJECTS: The aims and objects of the Society are:
- To maintain and manage the affairs of said Gurdwara in the best interest of Sangat in general and residents of the locality in particular.
- To purchase or take allotment on lease for the Gurdwara and allied purposes.
- To construct, repair and build other structure necessary for the extension of Gurdwara and allied purposes.
- To make arrangements for the education of the Children.
- To make arrangements for Medical Treatment.
- To open library for spreading the teachings of Gurbani, Sikhism and general knowledge.
- To celebrate Gurupurabs, organize langar, Amrit Parchar and other religious functions as per Sikh tenets and as decided by the Managing Committee.
- To disseminate the knowledge of Gurbani, Sikh religion and History and Social requirements.
- To preach and propagate piety and freedom of faith for all in keeping with spirit of unique sacrifice made by Guru Teg Bahadur Sahib for others since this place has been sanctified by Guru Sahib’s visit.
- To undertake Charitable work and other activities as are conductive to the achievements of the above objects.
- To provide boarding and lodging to Yartis for a limited period.
- To run Educational Institutions as and when possible.
- MEMBERSHIP: There shall be following classes of members of the Society:-
- Member General Body
- Member Executive Committee.
- MEMBER GENERAL BODY:- Every Gursikh who shall pay a subscription of Rs. 10/- per month may be member of Society provided he fulfills the following Conditions:-
- He makes an application on the Form prescribed as at Annexure ‘A’ for enrolment as the member of the society. The application must be submitted to the president, ‘or’, the General Secretary of the Society.
- He is an Amritdhari Gursikh and he abides by the rules and regulations passed by the Executive Committee/General Body from time to time.
- He does not use any type of intoxicants.
- He is 18 years of age or above.
- He abides by the tenets of Ten Gurus and Guru Granth Sahib.
- He is generally regular in coming to Gurdwara.
- He is of good Character and sound mind.
- a) No individual shall be eligible for membership of the society if he has been sentenced for any ‘offence involving dishonesty or moral turpitude within 5 years preceding the date of his admission as a member.
b) The Executive Committee of the society shall have a right to reject an application of any person for enrolment as member to whom the Committee does not consider a fit person to be enrolled as a member. Necessary reasons for rejection shall be recorded in the minutes of the Executive Committee meeting.
- The membership of General Body shall not ordinarily exceed one hundred members and not more than two members shall be admissible from same family. (Family means all those who live in one house under one head). However, some Gursikh who are useful, suitable and eligible from other sectors may also be taken as members in the society.
- Two residents of Ex-Village Fatehgarh (Madran) shall be taken as Ex-Officio members of the Society but they shall have no voting rights.
- MEMBER EXECUTIVE COMMITTEE: - An Executive member shall be a member of Executive committee duly nominated/selected by the president.
- GENERAL BODY:- All members on a given date for the meeting shall constitute the General Body of the Society.
- General Body of members of the Society shall meet from time to time at least once a year in the presence of Guru Granth Sahib. Meeting of the General body shall be conviened by the General Secretary of the Society under the direction of the Executive Committee. A General Body meeting shall also be conviened if the requisition for such meeting signed by not less than 1/3 of the total members is received by the Executive committee through the President/General Secretary. One General Body meeting shall be held in April every year but later than 30th June.
- At least a fortnight’s Notice specifying place time, date and agenda of the meeting shall be given to all the members. The Notice of the General Body meeting may be given in one or more of the following ways:-
- Affixing a copy of notice at the Society’s office Notice Board or at some conspicuous place in the Gurdwara premises OR
- By Circulation or advertisement OR
- By Post.
- QUORUM: The Quorum of the General Body meeting shall be 1/3 of total number of members, OR 30 members which ever is less. If at the time fixed for the General Body meeting the Quorum is not forth coming the President of the meeting shall, if the meeting has been called on the requisition of the members, annul it and no further general meeting shall be convened on the basis of the requisition with in six months. If the General Body meeting convened otherwise, than on requisition, the President shall postpone the meeting to a further date. A fresh notice for the subsequent meeting shall be given to all the members within a month. The business of the subsequent meeting may be transacted with the number of members present irrespective of quorum.
- Presiding officer to conduct the proceedings to elect the new President shall be nominated by a majority vote from the members present in the General Body meeting.
- The president or in his absence Senior Vice-President/Vice-President shall preside over the meetings of General Body. When both of them are absent the members shall elect a president for the meeting.
- Every member of General Body shall have one vote. Voting by proxy shall not be allowed. All matters shall be decided by a majority of votes of the members present. When the votes are equal the President of the General Body shall exercise the right of casting votes.
- POWERS OF GENERAL BODY:- The general body shall have the following powers and duties:-
- To elect president of the society for a term of three years.
- To consider and accept the annual report of the society its audited balance sheet and other agenda:
- Amendment of by-laws
- To transact such other business which may brought before the general body meeting by an ordinary member who shall have given at least 7 days clear notice in advance to the general secretary and allowed by the president.
- To make and execute the proposals for improvement in the administration of Gurdwara.
- Transaction of any other business connected with Gurdwara affairs with permission of the President of the General Body.
- Member who is in arrears of his membership subscription or enrolled within here months prior to the meeting shall be debarred from voting right.
- To ensure that all the business discussed and decided at the general body meeting shall be recorded in a proceeding book which shall be signed by the General Secretary and the President of the General Body.
- ELECTION:-
- At least one month’s notice specifying place, time, date of election and agenda of the meeting shall be given to all the members. This will also be displayed at the notice board along with list of members of the Society.
- PRESIDENT
- The Election of the President shall be held in the month of April after three years in the presence of Guru Granth Sahib and under the President ship of the Election President duly appointed by the general body for the purpose.
- EXECUTIVE COMMITTEE
- The election shall be held to fill up the office of the President who shall appoint the Executive Committee office bearers. If necessary the President may change any office bearer with majority vote of Executive Committee but he can change their duties.
- Efforts should be made to elect the President unanimously failing which by raising hands or otherwise by secret ballot if so demanded at the time of election.
9(i) CHANGE OF PRESIDENT
If at any time situation arises to change the president, a meeting of General House be convened as per procedure laid down and the house, if consider necessary change the President 2/3rd majority of votes.
- EXECUTIVE COMMITTEE:-
- The affairs of the society shall be governed by an executive committee which shall be nominated selected by the President from the members of the society and include the following office bearers:
- President One
- Senior Vice President One
- Vice President One
- Secretary One
- Cashier One
- Member In charge stores One
- Member In charge Library One
- Members not more than 16
- Total strength of the Executive Committee including office bearers shall not exceed 24 members.
- The Executive Committee will remain in office for a period of three years or until the new election for the President is held as per rules of the society within the maximum period of three months on the expiry of three years.
- No person shall be eligible for nomination that holds any office of profit under the society or is interested directly or indirectly in any contract with the society or an sale or purchase by the society privately or in auction.
- He shall cease to be a member of the Executive Committee, if at any time he becomes an employee of the society.
- Meeting of the Executive Committee shall generally be held every month. Ten members shall form a quorum. The President or the Senior Vice President/Vice President or in their absence a member elected by the members present in the meeting shall preside. All matters will be decided by majority of votes, the President shall have a casting vote in case of equality of votes.
- POWERS OF EXECUTIVE COMMITTEE:- The Executive Committee shall exercise all the powers and discharge all the duties of the society except those reserved for general body. In particular the Executive Committee shall have the following powers and duties:-
- To manage, supervise and look after all affairs and property of the society.
- To maintain true and accurate accounts of all money received and expended and all stocks bought and sold of the society.
- To keep a true and accurate account o the assets and liabilities of the society.
- To keep a register of members of the society.
- TO prepare and lay before annual general meeting an audited balance sheet of each calendar year.
- To arrange for the recovery of dues through legal action in the court or otherwise or appoint arbitrator and defend cases of society and defend cases of society and delegate legal powers to any member or employee of the society to pursue cases in the court.
- To give directions to General Secretary/Secretary to summon meetings in accordance with these Bye-laws.
- To arrange audit of the books and accounts of the society by a competent person.
- To appoint, suspend, dismiss or punish employees of the society for breach of service conditions, indiscipline and misbehavior.
- The Committee may also take proper securities/sureties from the employees as decided by the Executive Committee.
- To arrange safe custody of books and to appoint a member to take charge of all registers and papers prescribed in these By-laws.
- To accept/reject the resignation of a Executive Committee member. In case of acceptance the President may nominate another member.
- To invest surplus funds of the society in a bank or any other reliable institution.
- To purchase, hire, take on lease or otherwise acquire land or building required for the Society.
- To construct or repair Gurdwara building, sheds and raise other structures necessary for the allied purposes of the society.
- To arrange and celebrate Gurupurabs and other religious/Sikh cultural functions.
- To arrange for medical aid and to open dispensary.
- To install a library and arrange for general and religious education.
- The Executive Committee may constitute sub committees and delegate to them such powers and functions of the Executive Committee as it may consider fit during its own tenure only.
- To do all such matters, things and deeds this may be necessary or expedient for the society. In the conduct of business of the society the committee shall exercise the prudence and elegance of any person of business and shall be responsible to the society for any loss sustained through acts contrary to the bye-laws and the stated objects of the society.
- All business discussed or decided at the meeting of the Executive Committee/Sub-committee shall be recorded in a proceeding book which will be signed by the president and General Secretary of the meeting and shall be read out in the subsequent executive committee meeting for approval.
- No member of the committee shall vote on any issue in which he himself is interested directly or indirectly.
- TERMINATION OF MEMBERSHIP:- A person shall cease to be a member of the society if :
- He becomes of an unsound mind or insane.
- He is declared or implied to be declared as insolvent.
- He is convicted by a court for an offence of moral turpitude or he id declared to be insolvent by the court.
- He acts in prejudice to the interest of the society or whose conduct is found unsatisfactory by the Executive Committee.
- He does not pay his monthly subscription for the current year by 15th March, which will be the last date of payment. He shall cease to be a member provided the Executive Committee may restore the membership after charging all the arrears if deemed fit.
- He has expired.
- He will fully neglect to attend three consecutive meetings of Executive Committee. OR
- He has resigned. The Executive Committee on sufficient grounds may relax any condition or all the above conditions in particular or in special cases by a majority decision.
- PROPERTY OF THE SOCIETY:- The whole of the property moveable and immovable of the Gurdwara shall be deemed to vest in the name of the society. No individual shall have proprietary rights over it.
- DUTIES OF THE OFFICE BEARERS:
- PRESIDENT: The president shall be supreme executive of the Society.
- The president shall preside, conduct and regulate all the meetings of the society, executive committee or any other committee of which he may be a member according to the rules and regulations of the society.
- Ordinarily he should not exercise his vote in these meetings but in the event of a tie of votes, he shall have the casting vote as deciding factor.
- He shall be competent to incur an expenditure not exceeding Rs. 10000/- at any one time in anticipation of the sanctions of the Executive Committee.
- In any meeting if a member speaks ill of another member or disobeys the chair, the President shall have the powers to expel that member from the meeting.
- He will keep the duplicate keys of all the locks of the safes containing valuables and cash box/Golak held in Gurdwara and seal the locks.
- SENIOR VICE PRESIDENT/VICE/PRESIDENT:
- In case of temporary absence of the President, Senior Vice President/Vice-President shall preside all meetings of the society and shall exercise all such powers vested with the president except policy matters and financial powers. The Senior Vice-President/Vice-President shall perform such duties as will be assigned to him by the President.
- In case of inability of President to function as such Senior Vice-President/Vice-President shall be competent to perform all such duties and exercise all the rights of the President up to six month or till new election of the President which ever is earlier.
- GENERAL SECRETARY:
- It shall be the duty of the general secretary to execute the decision of the executive committee and the general body.
- He shall maintain the list of members and keep an account of membership fee.
- He will be personally responsible of day to day administration of the Gurdwara.
- He shall be competent to incur an expenditure not exceeding Rs. 5000/- for the purpose of Gurdwara at one time and ex-post facto sanction from the President and later approval by the executive committee obtained.
- He will act as a stage secretary and maintain decorum.
- He will be responsible for the conduct and functioning of Gurdwara staff and disburse their pay and grant them leave to which they may be entitled.
- He shall received the membership applications and submit the same to the President for consideration.
- He shall correspond on behalf of executive committee.
- He shall make sure that antecedents of all employees of the society are got verified by the police authorities/other available sources. The employee shall also furnish two sureties of the locality with regard to their character and integrity.
- SECRETARY: He shall prepare agenda and summon the meeting of executive committee and the general body with the consent of the President. He shall keep the minutes of the proceedings of every meeting of the society. He shall prepare the monthly and annual statement of accounts and submit the same to the executive committee and general body within the specified period. He shall ensure that all the account books are kept in proper order and safe custody. He shall also act as general secretary in his absence and carry out all such duties and all such powers entrusted, to him by President and general secretary.
- CASHIER: The cashier shall act under the direction of President/Senor Vice President and General Secretary. Any amount exceeding Rs. 2500/- which is not required for immediate use shall be deposited in the bank or as approved by the executive committee. He shall ordinarily receive all subscriptions, donations and contributions on behalf of society against proper receipts. He shall prepare and put up statement of receipts and expenditure to the Secretary every month for being put up in executive committee. He shall also put up annual statement of expenditure/receipts for the annual general body meetings. He shall maintain cash books ledger receipt books, vouchers, cash box (Golak Register) and stock register.
The cashier along with the secretary will get the monthly accounts checked before 20th of the following month to which the accounts pertain. He shall keep the keys of second lock of the cash Box (Golak). Both the locks of the cash box (Golak) shall be kept sealed and shall be opened twice a month in the presence of President/General Secretary and cashier who will also sign the entries in the cash book (Golak Register). All receipt books shall be kept in the custody of the cashier. At the time of issue of blank receipt books to any authorized person, he shall obtain signatures of the person to whom the books are issued.
As and when need arises, the executive committee may appoint an accountant who may be entrusted with some of the duties of the cashier for maintaining the accounts.
- AUDITOR: The executive committee shall appoint a qualified auditor who shall not be member of the executive committee. His tenure of office shall be the same as in the case of executive committee. The accounts of the society shall be audited by him at the end of each month for which the accounts are put up. He shall also record a certificate to this effect. He shall also audit the accounts of the committee at such intervals as executive committee may request him to do so. Executive committee may if necessary fix the fee of the auditor as per his qualifications.
- STORE INCHARGE: Store incharge shall act under the directions of the President and General Secretary. He shall maintain proper records of all the property including furniture, bedding, utensils, fixtures, rations, PA Equipment etc. He shall prepare stock register. He shall ensure that annual stock taking is done every year by a board of members appointed by the executive committee. Articles found unserviceable due to fair wear and tear will be struck off from the stock register on the recommendations of the board. Articles received as donations or purchased from Gurdwara fund shall be accounted for in the stock ledger except gold and valuable items. Gold and valuable items shall be kept under safe custody of cashier and recorded in the separate record register of valuables and entries thereof will be counter signed by the President.
- BOOKS AND REGISTERS: The following books and registers will be maintained:
- Proceeding book: Two separate books shall be kept for recording proceedings of General Body Meeting and executive meeting.
- Agenda book for meetings.
- Stock register.
- Cash book for receipts and payments.
- Ledger.
- Cash Book (Golak Register)
- Subscriptions register form membership of society.
- Receipt Books, Two types
- Monthly membership subscription
- Cash Donations Gold and valuable register
- Visitor register
- Anand Karaj register
- Staff Salary register
- Attendance register
- Employees enrolment register
- BANK DEPOSITS AND INVESTMENTS:- The banking accounts and other investments of the society shall be opened in the name of society. These shall be operated upon jointly by any two of the following office bearers:
- President/General Secretary/Senior Vice-President
- RESERVE FUND: A minimum amount of Rs. 2.00 lacs shall be kept as reserve fund of the society to meet any emergency requirements.
- AMENDMENT OF BYE-LAWS:- Any amendment to the by-laws of the society shall be affected by a 2/3 majority of the members present in general body meeting of the society convened with prior notice of the same in agenda. All forms of amendments in the bye-laws shall be communicated to the appropriate authority under the provision of society registration Act of 1860.
- MISCELLANEOUS:
- Should any doubt arise with regard to the interpretation of any of these bye-laws; the matter shall be referred to the General Body whose decision shall be final and binding.
- Amy decision taken by executive committee regarding disciplinary action against any employee shall be final and binding.
- All marriage ceremonies solemnized in Gurdwara premises shall be recorded by the Gurdwara Manager appointed by the Executive Committee in a register and signed by the parties concerned and Head Priest/Priest.
- All persons coming from outstations may be allowed to stay for one day which may be extended up to 3 days by president/Senior Vice President/General Secretary as a special case. They shall not be allowed to bring tobacco, liquor any other intoxicant, or arms/ammunition in the Gurdwara premises. Visitors shall sign an undertaking to that effect.
- DISSOLUTION OF THE SOCIETY:- If on the dissolution of society there shall remain after the satisfaction of its debts distributed among the members of the society or any of them but shall be given to some similar objects as those of the society.
The society shall be dissolved when 5/6th members of general body agree to dissolve. When the liabilities of society are more than the assets there of and it is not possible to repay them, the society shall not be deemed to are dissolved unless such liabilities are satisfied.
- HANDING/TAKING OVER CHARGE:- Handing and taking over charge of all documents, books and records, valuables shall be carried out between the outgoing and newly elected President of the society and nominated office bearers as per the details recorded in the register which shall be signed by both the President and general Secretary.
